LATER this week a court will be asked to decide whether EU workplace discrimination laws cover discrimination on grounds of obesity.
The Court of Justice of the European Union will, on Thursday, be considering a number of questions resulting from the case of Karsten Kaltoft v Billund Kommune, which was passed on by a Danish court for a preliminary ruling last year.
The court will be asked whether it is contrary to EU law for an employer to discriminate on grounds of obesity, and if so, also whether obesity can be deemed to be a disability for the protection provided for by the equal treatment framework Directive, and if so what are the criteria for assessment.
